Information on the processing of personal data

This statement, made in accordance with Art. 13 of Reg. 2016/679 (GDPR), is provided in order to make navigation within the Website by Users transparent and secure, clarifying the purposes for which personal data are collected and the methods of processing, as well as the procedures by which the same Users can update, manage, modify and delete their information.

Type of data collected

Through the Website we collect various personal data from Users that are suitable for identifying them, such as master data and/or accounting data. In particular, we collect the following personal data:

  1. Browsing Data: information recorded by our computer systems during Users’ browsing and activity in providing their services. For better information on the types of data collected we invite Users to also read the Cookie Policy. This includes the following data:
    • Information related to Internet communication protocols, IP addresses, and computer system access logs;
    • Data related to browsing and previously visited websites;
    • The data provided by the browser used by the User;
  2. Data provided voluntarily and directly by the User: The User, by registering or using the services offered on the Website, voluntarily discloses his/her personal data. This includes the following data:
    • Biographical data (e.g., first name, last name, address, social security number)
    • Communication data (e.g., phone number, email address)
    • Accounting data (e.g., means of payment)
    • Data included in documents submitted by Users (e.g., identity documents, etc.).
  3. Third-party data voluntarily provided by the User: The User may also voluntarily provide data from third parties, who have no relationship with the Owner, for example through uploading content to the Website. For this type of data, see the point below. This includes the following data:
    • identifying data of third parties (e.g.: names of individuals who will be staying with the User; etc.)
    • third-party accounting data
    • Data included in documents submitted by Users (e.g., technical documentation)

In the event that the User communicates third-party content to the Owner, the User declares that he/she has collected the necessary consent for the processing of personal data, and the communication of the same to the Owner.

Purpose of Treatment

Personal data collected through the Web Site are processed by the Data Controller for the following purposes:

  • To enable Users to use the Web Site and the services offered through it;
  • Acquire and confirm reservations and ancillary services, and to provide requested services;
  • Fulfill the obligation under the “Consolidated Law on Public Security” (Article 109 R.D. 18.6.1931 No. 773) that requires us to notify the Police Headquarters, for public security purposes, of the particulars of the customers accommodated in accordance with the procedures established by the Ministry of the Interior (Decree January 7, 2013);
  • To fulfill current administrative, accounting and tax obligations;
  • Speed up registration procedures in case of subsequent stays at our facility;
  • Provide information about the stay (mail, messages, visits and phone calls);
  • Statistical and market analysis;
  • Manage access to any restricted areas;
  • Send communications to Users and/or communicate with them in case of requests for technical assistance and/or information;

In addition, with Users’ consent, we may also:

  • To send information and updates in relation to offers, promotions and events related to our activity, through the sending of informative and advertising material;
  • To carry out a direct sales service of the Services and content of the Web Site.
Compulsoriness of contribution

The provision of data by the User is optional. However, the failure to provide personal data may result in the impossibility of providing the requested services and/or to fulfill contractual obligations on the part of the Owner (e.g.: in the case of not providing data to make payments).

In any case, the provision of data is always mandatory when they are necessary to fulfill a legal obligation (e.g., in the case of sending under the Consolidated Law on Public Security; fulfillment of accounting obligations; etc.).

Legal basis for processing

The Owner carries out the processing of personal data in the manner indicated in Art. 6 of Reg. 679/2016, and in particular after collecting consent from the User.

The Controller may, in any case, process Users’ personal data even without their consent in the following cases:

  • the processing is necessary for the performance of a contract to which the User is a party or the execution of pre-contractual measures taken at the User’s request;
  • processing is necessary to fulfill a legal obligation to which the Data Controller is subject;
  • processing is necessary to safeguard the vital interests of the User or another natural person;
  • processing is necessary for the performance of a task carried out in the public interest or in connection with the exercise of public authority vested in the data controller;
  • processing is necessary for the pursuit of the legitimate interests of the data controller or a third party, provided that the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data are not overridden, particularly if the data subject is a child.
Method of treatment

The processing of personal data will be carried out by individuals authorized to do so (e.g., employees and collaborators), at our offices, both by paper and by computer/telematic methods, with logics strictly related to the purposes specified in the privacy policy, and in any case in such a way as to ensure compliance with the measures prescribed by Reg. 679/2016 to guarantee the security and confidentiality of the data themselves, as well as respect for the fundamental rights and freedoms of Users, and their dignity.

The information systems and computer programs are configured in order to minimize the use of personal data and identification data, so as to exclude their processing when the purposes pursued in individual cases can be achieved by means of, respectively, anonymous data or appropriate methods that allow identifying the data subject only when necessary.

We also ensure data security through appropriate backup and data recovery systems.

Duration of Treatment

Personal data will be retained as long as necessary for the provision of the Services (e.g.: until the account is deleted from the Website) and/or until consent is revoked and/or as long as the uploaded content is available on the Website itself.

In the case of revocation of consent and/or at the end of the provision of the Services, the data will be retained for the terms established by law for the fulfillment of e.g. civil and tax obligations, and in any case for a term of not less than 10 years.

Transfer of personal data

Personal data will be retained as long as necessary for the provision of the Services (e.g.: until the account is deleted from the Website) and/or until consent is revoked and/or as long as the uploaded content is available on the Website itself.

In the case of revocation of consent and/or at the end of the provision of the Services, the data will be retained for the terms established by law for the fulfillment of e.g. civil and tax obligations, and in any case for a term of not less than 10 years.

Sharing of personal data

Users’ personal data may be disclosed, in addition to employees and/or authorized processing contractors, to:

  • Subjects with whom it is necessary to interact for service delivery, including:
    • Subjects to whom the communication is necessary to provide the requested services
    • Persons delegated to carry out technical activities
    • Other employees and/or contractors specifically authorized to process
  • Subjects we use to send commercial information.
  • Professional firms providing assistance and consulting in accounting, administrative, legal, tax, and financial matters.
  • Judicial authority for purposes of enforcement and investigation.

Users’ data will never be disseminated.

Rights of data subjects

Each User and/or Data Subject may at any time exercise the rights provided by Articles 15-22 of Reg. 679/2016, and in particular:

  • revoke their consent to the processing of personal data, in cases where the processing of data is based on the consent given by them;
  • to know whether the Controller holds and/or processes personal data of the same and to access them in full including by obtaining a copy (Art. 15 Right to Access);
  • Request rectification of inaccurate personal data or supplementation of incomplete personal data (Art. 16 Right of Rectification);
  • To request the deletion of personal data held by the Data Controller if there is one of the grounds provided by Reg. 679/2016 (Right to Erasure, 17);
  • To ask the Data Controller to limit processing to only certain personal data, in the cases provided for (Art. 18 Right to limitation of processing);
  • request and receive their personal data processed by the owner, in structured, commonly used and machine-readable format or request transmission to another owner without hindrance, in the cases provided for (Art. 20, Right to Portability);
  • object in whole or in part to the processing of data for the purpose of sending commercial and/or promotional material, as well as to any related profiling activity (Art. 21, Right to object);

Each Data Subject may exercise these rights by notifying the Data Controller, at the addresses indicated in the header. In addition, the Data Subject always has the right to lodge a complaint with the Data Protection Authority pursuant to Art. 77 of Reg. 679/2016

Miscellaneous

We reserve the right to change the content of this Privacy Policy at any time by giving notice in the forms of use and otherwise by posting on the Web Site.
Changes will be effective, unless otherwise notified, from the time of publication of the update.
